The government of the Netherlands is actively exploring the implementation of a highly restrictive legislative package that could enforce a complete, blanket ban on all online gambling ads and player bonuses.
The sweeping policy proposals were officially announced by Justice and Security State Secretary Claudia van Bruggen, signaling a further tightening of one of Europe’s most rigid regulated gambling regimes.
Introducing Affordability Restrictions and Automated Site Blocking
The newly unveiled regulatory roadmap is drafted as a direct state intervention to combat disconcerting gambling harm indicators recorded across the country. Since the initial re-regulation of the Dutch remote market, enforcement agencies have logged rising addiction metrics, particularly concentrated among younger player demographics. To insulate vulnerable consumers, the Ministry of Justice intends to deploy several advanced protective frameworks:
- Total Marketing Bans: Implementing a complete prohibition on all public iGaming advertisements and promotional sign-up bonuses to eliminate financial inducements.
- Affordability Controls: Hard-coding strict deposit limit rules and mandatory income-based checks to ensure consumers do not spend more capital than they can safely afford.
- Extended Self-Exclusion: Modifying the national self-exclusion register (CRUKS) so that voluntary bans do not automatically expire on a set date, remaining active until a player manually requests removal. The update would also allow direct family relatives to submit an exclusion request for a loved one suffering from severe harm.
- IP Disruption Powers: Granting the Kansspelautoriteit (KSA) formal legal authority to systematically block the web domains and IP addresses of unlicensed offshore gambling websites.
The initial proposals will now be drafted into a formal bill by state legal teams before being presented to parliament for deliberation at a later date.
Critics Warn of Black Market Growth
The Netherlands already enforces a stringent regulatory framework; the state previously banned untargeted mass media advertising and enacted a comprehensive prohibition on sports sponsorships with gambling operators, alongside banning the use of recognizable role models or celebrities in marketing content to protect minors from developing bad habits. However, industry analysts and trade groups warn that over-regulating product channels may trigger severe adverse effects.
Critics argue that a blanket advertisement ban will significantly impair the ability of licensed operators to effectively distinguish themselves from offshore platforms, inadvertently empowering unregulated networks. Furthermore, the push follows recent gaming tax hikes that have heavily compressed corporate margins, prompting the state-backed Dutch Lottery to explicitly urge lawmakers to reject further gambling tax increases to preserve domestic market channelisation.
