Law firm SANDS has finalized a massive legal coalition of over 17,000 participants for what is now the largest class action lawsuit in Norwegian history. The target is the state-owned gaming monopoly Norsk Tipping, which faces allegations of systemic errors in its Lotto and Eurojackpot draw systems spanning nearly a decade.
The Basis of the “Clear Defect”
The litigation stems from confirmed technical faults that, according to the Norwegian Gambling Authority, significantly reduced players’ statistical chances of winning. SANDS partner Lars Tormodsgard argues that these discrepancies constitute a fundamental defect in the gaming product offered to the public.
Tormodsgard explained to NRK:
“There were errors in the draw basis for both Lotto and Eurojackpot. As a result, individual players had lower winning chances than what was communicated… There is a wide range within this group. Some have played for small amounts, while others have spent substantial sums.”
Norsk Tipping’s Defense and Regulatory Fallout
Participants are seeking full refunds for stakes placed between 2015/2016 and 2025. However, Norsk Tipping’s legal counsel, Henning Harborg, has rejected the grounds for a total refund, arguing that the errors only affected “additional draws” rather than the primary prize rounds.
The case follows a string of operational failures for the state operator, which has been slapped with fines totaling more than NOK 119 million in recent years, including a NOK 46 million penalty specifically linked to draw errors.
