Malta Unveils Pro-Business Tax Overhaul to Cement Status as iGaming Hub

The Malta Tax and Customs Administration, in close coordination with the Malta Gaming Authority (MGA), has finalized a sweeping renovation of the jurisdiction’s VAT and gaming tax frameworks.

Scheduled to take effect on October 1, 2026, the reforms follow the publication of Legal Notices 84 and 86, aiming to provide iGaming operators with unprecedented financial clarity and administrative relief.

Redefining VAT and Unlocking Cost Recovery

A central pillar of the reform involves amending the VAT Act (Chapter 406) in Malta. Authorities have narrowed the traditional scope of gambling exemptions, a move that ironically benefits operators. By clearly defining which services, particularly in sports betting and specific casino verticals, are subject to tax, the law now grants companies a natural right to recover Input VAT.

Previously, iGaming firms were often unable to reclaim taxes paid on essential overheads. Under the new regime, operators can recover costs related to:

  • Software Infrastructure: Critical for high-performance platforms.
  • Marketing & Operational Services: The primary drivers of user acquisition.

This shift is viewed by industry experts as a massive operational victory, directly boosting profit margins for companies headquartered on the island.

Simplified Unified Gaming Tax

Alongside the VAT updates, the MGA is consolidating the existing, often confusing multi-tier tax structures. Starting in October, the traditional gaming tax and the gaming device levy will be merged into a single, unified tax based on specific game types and offer modes.

This consolidation applies to both land-based and digital operators providing services to players physically located within Malta. By eliminating the need for complex multi-tier reporting, the administration is effectively removing “administrative headaches” for compliance teams.

Malta’s decision to simplify its code stands in sharp contrast to many global jurisdictions currently increasing regulatory complexity. By listening to industry feedback and setting a definitive “accounting software upgrade” deadline for October, the government is signaling its long-term commitment to the iGaming sector.
