This clarification removes the grey areas that international platforms previously relied upon as they entered the market.

Operational Divide: Local vs. Foreign Operators

The SRI has made it clear that digital services delivered online with minimal human input fall under VAT. This includes sports betting, prediction platforms, certain paid online games, and even sports streaming tied to subscriptions. The way the tax is applied depends on where the operator is based:

  • Local Companies: Expected to handle VAT like any other business, charging it directly to customers, issuing receipts, and taking care of reporting and payments themselves.
  • Foreign Platforms: If a platform relies on a local payment provider, that intermediary becomes responsible for collecting the VAT. The tax is withheld at the point of payment and then transferred to the authorities.

The Burden on the Player

The more unusual part of the guidance comes when there is no intermediary involved. In those cases, the responsibility moves to the user, and players are expected to declare and pay the VAT themselves. On paper, this fills a gap; in practice, it raises obvious questions about compliance, as many users may not be aware of this obligation.

By focusing on the flow of money through payment intermediaries, Ecuador is focusing on the flow of capital rather than chasing operators across borders. It is a practical solution that ensures the growing betting sector is pulled into the formal digital economy, even if it results in higher costs for the end-user.

As Latin America continues to attract international iGaming companies, this fiscal VAT tightening signals that Ecuador is no longer treating online betting as a loosely regulated space.
