Dutch Gaming Authority KSA Re-enforces Compliance Focus as Betnation and 711 Group Face Regulatory Action

The Dutch Gaming Authority (Kansspelautoriteit – KSA) has continued its aggressive, zero-tolerance enforcement focus across the regulated remote market, issuing a series of severe administrative sanctions and warnings to several licensed operators.

In its latest regulatory sweep, the state watchdog directed an official warning at Smart Gaming, the corporate entity behind the prominent B2C brand Betnation, following documented operational failures connected to the Cruks national self-exclusion register.

The administrative intervention was triggered after an audit established that Betnation failed to execute mandatory verification checks to determine whether a specific group of players were listed on the central exclusion database between January and March 2026. As a direct result of this technical omission, impacted consumers were permitted to deposit capital and gamble sitewide without their status being verified against the national database.

Shockingly, the regulator confirmed that at least one consumer who had previously self-excluded to manage a gambling dependency was allowed to open an active session and wager unhindered.

Technical Errors and Compensatory Restitution Frameworks

Betnation immediately attributed the compliance breakdown to an isolated, automated technical error inside its core API connection layers, which temporarily prevented the automated database verification queries from processing during the onboarding cycle. Following internal detection, the operator manually audited the accounts of all players active during the affected time frame. However, the brand admitted to the KSA that it was completely unable to definitively verify the historical exclusion status of a small sub-segment of consumers during the impacted dates.

Because Betnation proactively self-reported the operational issue to the state watchdog, enacted immediate technical remedies, and executed a voluntary restitution program to financially compensate all affected consumers, the KSA determined that an official administrative warning was sufficient in this specific instance. Furthermore, the operator has pledged to collaborate directly with several specialized responsible gambling organizations to provide extended clinical assistance and behavioral counseling to the impacted individuals.

Massive 711 Financial Penalties and TOTO World Cup Infringements

The regulatory pressure from the Dutch supervisor has escalated rapidly across the broader market during June. Earlier this week, the KSA formally called out TOTO Online for violating strict national marketing limits during a high-profile World Cup advertising campaign. The compliance breach involved eight independent professional football clubs that promoted an interactive competition offering fans the chance to win signed team jerseys provided they placed an active €5 wager through TOTO Online’s sportsbook app.

While the operator maintained that the promotional copy was structured legally, the KSA ruled that utilizing active athletic clubs and former professional athletes constituted the unlawful use of role models for promotional purposes.

Concurrently, the 711 Group was hit with a massive administrative fine totaling nearly €900,000 following an extensive historical investigation into the brand’s customer duty of care violations between February 2022 and June 2024. The KSA’s forensic enforcement teams established that 711 failed to properly analyze volatile player behavioral data and omitted mandatory intervening measures, leaving high-risk consumers free to gamble out of control and suffer massive financial losses.

“The KSA considers it highly reprehensible that the Cruks checks were not carried out. Players who register themselves in Cruks do so to protect themselves and must be able to assume that, as a result, they cannot gamble at licensed providers.”
