In a decision that shifts the legal landscape for the offshore iGaming sector, the highest legal authority in the Dutch Caribbean has ruled that an international player refund judgment must be enforced locally.
The Joint Court of Justice of Aruba, Curaçao, Sint Maarten, and of Bonaire, St. Eustatius and Saba found in favor of an Austrian gambler seeking to recoup historical grey-market losses from an island-based operator. Legal analysts believe the precedent marks a watershed moment in the long-running cross-border player refund saga.
Enforcing the Austrian Judgment
The milestone decision traces back to a 2023 ruling by an Austrian tribunal. That court concluded the plaintiff was legally entitled to a full refund of €25,518.42 lost to Raging Rhino N.V., the corporate entity behind the digital casino brand LuckyDays. While thousands of similar pro-consumer judgments have been issued across Germany and Austria over the past five years, collectively totaling hundreds of millions of euros, offshore operators have routinely managed to block enforcement by operating from gambling-friendly hubs.
Historically, this litigation wave primarily targeted Malta, where many grey-market providers maintain principal corporate headquarters. In response, Malta passed “Bill 55,” an asset-protection law that empowers local judges to block foreign judgments if they are deemed to threaten domestic economic stability or public order. Although Bill 55 faces challenges before the Court of Justice of the European Union (CJEU), it has successfully stymied European collection efforts.
Hoping to replicate the Maltese defense, Raging Rhino argued before the Caribbean panel that honoring the Austrian refund would violate Curacao’s public order. However, the Joint Court rejected the argument, refusing to allow the operator to re-litigate the core merits of the case. The judges clarified that their sole jurisdictional task was to verify whether the foreign ruling met the baseline criteria for safe local recognition. According to reports from the Curacao Chronicle, Raging Rhino was ordered to recognize the debt and pay an additional €2,286.72 in localized court costs.
Transparency Reforms Fuel Litigation Risks
Though the immediate financial sum is modest, the judgment exposes Curacao’s large offshore community to systemic financial risks. For years, litigation funding firms and specialized European legal teams have been acquiring player claims, targeting any operator that accepted wagers in Germany or Austria without a localized license.
This legal exposure arrives as Curacao undergoes a regulatory transformation. Historically shielded by opaque corporate layers, recent island reforms require operators to transition onto an open public registry to maintain active licensing. According to official registry data, Raging Rhino’s core Curacao license expired on March 26, and the company is operating under an application that is currently being assessed. This push for transparency has inadvertently removed the anonymity that once insulated these businesses from international process servers.
Legal experts anticipate this weak point will spark a flurry of enforcement transfers from central Europe. The ruling could prompt a full operational exit from German and Austrian player pools by Curacao-licensed brands. This would duplicate the operational flight seen in Malta, where the persistent threat of collection actions forced un-licensed slots and sports betting providers to completely abandon both Central European jurisdictions.
