
Following a period of regulatory review and public feedback, DraftKings has agreed to implement significant structural changes to its recently launched DK Replay product in Oregon.
The decision comes after the Oregon Lottery engaged the Boston-based operator to address specific “comments” regarding the pace and nature of the historical betting experience.
Slowing the Pace for Player Safety
DK Replay is a specialized sports betting product that allows users to wager on archived MLB at-bats. Unlike traditional virtual sports, it does not use a Random Number Generator (RNG); instead, it draws from a massive database of hundreds of thousands of previously offered markets to simulate a live game environment.
To address concerns regarding the speed of these predetermined outcomes, the Oregon Lottery and DraftKings “collectively decided to adjust DK Replay to more closely resemble the pace of a live baseball game”.
Melanie Mesaros, External Communications Program Manager for the Oregon Lottery, confirmed that the update would also introduce mandatory responsible gaming prompts at regular intervals to prevent compulsive play.
Authorization and Integrity Monitoring
Despite the required adjustments, the regulator maintains that the product sits firmly within legal boundaries.
“We believe this wagering opportunity falls within what DK is currently authorized to offer within our sports betting product,” Mesaros stated.
She emphasized that because the outcomes are tied to real professional sporting events overseen by governing bodies with active integrity monitoring, the product is distinct from casino-style games.
Furthermore, the markets remain anonymized during the wagering process, meaning that while the result is technically a matter of historical record, the player has no way of knowing the outcome before the pitch is revealed.
DraftKings, which views Oregon as a testing ground for the product, intends to roll out DK Replay to additional US markets pending similar regulatory approvals. Existing transparency tools, including activity tracking and limit-setting, will continue to apply to the updated version.
