The inquiry centers on the state-owned operator’s failure to deploy its “Bet da Caixa” platform despite having secured and paid for a federal license nearly a year ago.

The ruling, signed by Minister Jhonatan de Jesus, suggests a potential violation of the principle of economic efficiency and a possible misuse of public funds.

Economic Inefficiency and Licensing Waste

The investigation was triggered by a request from the Federation of Lottery Companies (Febralot), which argues that the continued inactivity is squandering the license’s five-year validity period. Having already paid BRL 30 million for the authorization provided by the Ministry of Finance’s Secretariat of Prizes and Betting in July 2025, Caixa is reportedly losing roughly BRL 6 million per year in potential value.

Febralot and other industry stakeholders are concerned that while private operators are rapidly capturing market share, the state-owned lottery network is losing ground. This delay is particularly sensitive given the upcoming 2026 World Cup, a period expected to see an unprecedented surge in wagering demand that the state operator is currently unequipped to capture.

TCU Demands Administrative and Technical Transparency

Minister Jhonatan de Jesus has issued a strict directive, giving Caixa Loterias S.A. five working days to provide a formal explanation for the technical and operational delays. A further 15-day window has been granted for the submission of detailed supporting documents, including:

  • Compliance and Security: Evidence of robust integrity and anti-fraud systems.
  • Responsible Gaming: Clear documentation on self-exclusion tools, betting limits, and age verification mechanisms.
  • Third-Party Oversight: Clarification on the roles and fiscal responsibilities of technology providers and subcontractors.
