The high-stakes legal battle between Curaçao-based crypto casino Stake.com and Australian stock-trading platform Stake.com.au is set to intensify, with new court hearings and subpoenas scheduled in Australia.

The dispute centers on alleged trademark infringements and misleading or deceptive conduct, with each company claiming the other is damaging its brand and confusing consumers in the Australian market.

The conflict began when Stake.com.au, which launched in 2017, filed a lawsuit against Stake.com, which began operating in 2021, after the latter increased its marketing efforts in Australia, including a major sponsorship deal with the Alfa Romeo Formula 1 team.

Stake.com.au argues that the crypto casino’s activities are causing significant brand confusion and harm. In response, Stake.com filed a cross-claim, alleging that the Australian trading platform is infringing on its own established trademarks and has acted in bad faith.

The case has now reached a critical phase, with Stake.com.au successfully obtaining subpoenas to compel witness statements from key media companies, including SBS and Nine Entertainment, who were involved in broadcasting the Formula 1 races featuring Stake.com’s branding.

These statements will be crucial in determining the extent of any consumer confusion.

A hearing for the subpoenas is scheduled for October 13, with a broader case management hearing set for December 15.

The ongoing legal proceedings have also drawn the attention of the Australian financial regulator, ASIC, which has reportedly been investigating Stake.com.au over its “Stake-branded products,” adding another layer of complexity to the dispute.

The outcome of this case could have significant implications for both companies and set a precedent for trademark law in the digital age, particularly for brands operating in similar online spaces with international reach.
