Stake has secured a temporary reprieve from the recently introduced online gambling ban in Brazil by bringing its case before a court in São Paulo. Judge Cristiane Farias Rodrigues dos Santos of the 9th Federal Civil Court of São Paulo granted the Easygo brand a partial preliminary injunction, signed on Thursday, October 8, allowing operations to continue under strict conditions until October 25.
Navigating the provisional measure and transition window
Under the provisional measure published on September 25, online gaming operators in Brazil were initially ordered to cease activities by October 6. However, the court ruling highlighted that the measure dictates the expiry of existing licensed activity after 30 days, meaning operators should be afforded a transition period. While Stake sought an extension through the full 2029 expiration date of its original five year licence, the court limited the temporary reprieve to October 25.
Stake reported that it is the first licensed operator to obtain a judicial decision of this nature, following similar moves by industry giants like Flutter Entertainment and Betano to evaluate legal options against the ban.
Executive commentary
Welcoming the judicial decision, a representative statement from Stake Brasil emphasized the importance of legal certainty:
“The decision represents an important signal for Stake Brasil and for all those who operate under state authorization and supervision.”
The company added:
“By recognising that an authorization obtained by fulfilling all legal requirements, paying the grant fee and making significant investments confers a legal position that cannot be suppressed without due consideration, the Court reaffirmed the importance of legal certainty and the stability of rules.”
Stake Brasil further noted its commitment to compliance:
“Stake Brasil understands that consumer protection is one of the main benefits of a regulated market. It is in this environment, with clear rules, responsible gaming mechanisms and public authority oversight, that this protection becomes effective.”
