
Danish Gambling Authority Intervenes as Landmark Dispute Over Player Account Security Prepares for Final Legal Test
In a major legal development for the iGaming industry, the High Court has ruled in favor of a player, determining that funds held in gaming accounts with the bankrupt company DK Gambling ApS enjoy special protection and belong exclusively to the player, separate from the claims of the estate’s other creditors.
The November 13, 2025 High Court judgment successfully reversed a previous ruling by the Maritime and Commercial Court. Following the appeal, the bankruptcy trustee applied for and was granted permission to bring the case before the Supreme Court, with the proceedings officially scheduled for March 10, 2027. The Danish Gambling Authority has received permission to intervene in the upcoming Supreme Court proceedings to support the player’s claim.
Case Background and Legal Significance
The dispute originated following the bankruptcy proceedings initiated against DK Gambling ApS in April 2022. At the time, the bankruptcy estate’s trustee refused to disburse player account balances, arguing that player funds lacked the specific bankruptcy protection outlined in gambling legislation.
This refusal prompted a legal challenge from a player asserting a separatist claim over their funds. Although the bankruptcy estate initially secured an acquittal in the Maritime and Commercial Court, the High Court overturned the decision, affirming that player balances at the time of bankruptcy are specially protected and exempt from general creditor distribution.
The upcoming Supreme Court hearing will establish a critical legal precedent regarding player fund security and regulatory protections during operator insolvencies in Denmark.
